1. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

Personal Information Provided by You. The personal information that we collect may include the following:

  • names
  • phone numbers
  • email addresses
  • job titles
  • usernames
  • passwords
  • contact preferences
  • contact or authentication data
  • precise location data
  • user-provided photo or video content

Sensitive Information. When necessary, with your consent or as otherwise permitted by applicable law, we process the following categories of sensitive information:

  • data about a person's sex life or sexual orientation;
  • information revealing race or ethnic origin;
  • information revealing political opinions;
  • information revealing religious or philosophical beliefs;
  • biometric data;
  • precise geolocation data;
  • behavioral and personal life data including routines, hobbies, personality/behavioral traits, and personal relationships.

Social Login Data. We provide you with the option to register and sign in using an existing Google or Apple account. If you choose to register in this way, we will collect certain profile information about you from the social media provider, as described in the section called “HOW DO WE HANDLE YOUR SOCIAL LOGINS?” below.

Application Data. If you use our application(s), we also may collect the following information if you choose to provide us with access or permission:

  • Geolocation information. We may request access or permission to track location-based information from your mobile device, either continuously or while you are using our mobile application(s), to provide certain location-based services. If you wish to change our access or permissions, you may do so in your device's settings.
  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's calendar, contacts, camera, microphone, social media accounts, sms messages, storage, and other features. If you wish to change our access or permissions, you may do so in your device's settings.
  • Contacts. If you choose to look for people you already know, the app reads the phone numbers and email addresses in your device’s address book — it does not read names — and converts each one on your device into a cryptographic hash (SHA-256) before anything is sent to us. Only those hashes are sent: the phone numbers and email addresses themselves never leave your device, and neither they nor the hashes are stored on our servers. We compare the hashes against the hashed phone numbers and email addresses of existing accounts so we can show you which of your contacts already use Beacon, and we discard the hashes once we have answered. The same phone number or email address always produces the same hash, so a hash is not anonymous. This runs when you choose it, and the app does not keep your address book in sync afterwards.
  • Mobile Device Data. We automatically collect device information (such as your mobile device ID, model, and manufacturer), operating system, version information and system configuration information, device and application identification numbers, browser type and version, hardware model, Internet service provider and/or mobile carrier, and Internet Protocol (IP) address (or proxy server).
  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

Information automatically collected

In Short: Some information, such as your Internet Protocol (IP) address and/or browser and device characteristics, is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. Like many businesses, we also collect information through cookies and similar technologies.

  • Log and Usage Data. Service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files.
  • Device Data. Information about your computer, phone, tablet, or other device you use to access the Services.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. However, if you choose to opt out, you may not be able to use certain aspects of the Services.

Google API

Our use of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law.

We process your personal information for a variety of reasons, depending on how you interact with our Services, including:

  • To facilitate account creation and authentication and otherwise manage user accounts.
  • To deliver and facilitate delivery of services to the user.
  • To respond to user inquiries and offer support to users.
  • To send administrative information to you.
  • To fulfill and manage your orders, payments, returns, and exchanges made through the Services.
  • To enable user-to-user communications.
  • To request feedback.
  • To send you marketing and promotional communications, in accordance with your marketing preferences.
  • To deliver targeted advertising to you, by developing and displaying personalized content and advertising tailored to your interests, location, and more.
  • To protect our Services, including fraud monitoring and prevention.
  • To identify usage trends.
  • To determine the effectiveness of our marketing and promotional campaigns.
  • To save or protect an individual's vital interest.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law.

If you are located in the EU or UK, this section applies to you. The General Data Protection Regulation (GDPR) and UK GDPR require us to explain the valid legal bases we rely on in order to process your personal information. We may rely on the following legal bases: consent; performance of a contract; legitimate interests (including to send information about offers, develop and display personalized advertising, analyze usage, support marketing, diagnose problems, and understand product use); legal obligations; and vital interests.

If you are located in Canada, this section applies to you. We may process your information if you have given us specific permission (express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (implied consent), and in certain exceptional cases permitted by Canadian law.

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers. We may share your data with third-party vendors, service providers, contractors, or agents (“third parties”) who perform services for us or on our behalf and require access to such information to do that work. The categories of third parties we may share personal information with are as follows:

  • Affiliate Marketing Programs
  • Cloud Computing Services
  • Finance & Accounting Tools
  • Data Analytics Services
  • Data Storage Service Providers
  • Communication & Collaboration Tools
  • Performance Monitoring Tools
  • User Account Registration & Authentication Services
  • Website Hosting Service Providers
  • Sales & Marketing Tools

We also may need to share your personal information in the following situations:

  • Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
  • When we use Google Maps Platform APIs. We may share your information with certain Google Maps Platform APIs (e.g., Google Maps API, Places API) to retrieve information when you make location-based requests. Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. We obtain and store on your device (“cache”) your location for one (1) month. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document.
  • Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this Privacy Notice.
  • Business Partners. We may share your information with our business partners to offer you certain products, services, or promotions.
  • Other Users. When you share personal information or otherwise interact with public areas of the Services, such personal information may be viewed by all users and may be publicly made available outside the Services. Registering with Google or Apple does not share your activity back to those providers, and nobody in your contacts there is shown what you do on Beacon.
  • Invitations and Shared Links. The Services may let you share a link to your profile or to a gathering, or invite others to join. These links are generated and processed by us; we do not use a third-party deep-linking or attribution provider for this feature. Sharing uses your device's native share functionality: we may pre-fill a suggested message, but you choose whether and how to send it and may edit it first, or you may simply copy the link. When you share such a link, limited profile or gathering information may be viewed by anyone who has the link, including people who are not yet users.
  • Amazon Web Services (AWS). AWS hosts the Services. Our servers, our database and our file storage all run on AWS, which means everything you provide to Beacon — your profile, your photos and videos, your messages, and the places you save — is stored on infrastructure AWS operates for us. We also use three AWS services directly: Rekognition Face Liveness performs the optional face check (see our Biometric Data Notice; no facial image or face template is retained by us or by AWS), Simple Email Service sends our email including your sign-in code, and CloudFront delivers our site, our images and our map tiles, which means it sees your network address.
  • Google. We use several Google services, each for a different purpose. Google Maps Platform (Maps, Places, Geocoding and Time Zone) draws the map and turns coordinates into place names, and receives the area of the map you are viewing and the place searches you type. Firebase Cloud Messaging delivers push notifications, and so receives a token identifying your device together with the notification itself, which can include another person’s name or a preview of a message. Firebase Remote Config lets us change app settings without shipping an update, and receives an app-instance identifier. Play Integrity, on Android only, checks that the app is genuine and running on a genuine device, and receives a token about the app and device that does not identify you. In the iOS app only, Firebase Crashlytics, Analytics and Performance Monitoring provide crash, usage and performance diagnostics; these are not present in the Android app. On our website only, Google Analytics 4 and Google Tag Manager provide website analytics after you opt in, as described under “Analytics” below, and our blog loads typefaces from Google Fonts, which receives your network address.
  • Apple. Sign in with Apple lets you register and sign in, as described in “HOW DO WE HANDLE YOUR SOCIAL LOGINS?” below. The Apple Push Notification service delivers push notifications to iPhones and iPads, and in the iOS app Apple’s MapKit draws the map and therefore receives the area of the map you are viewing.
  • Twilio. Twilio sends and checks the one-time codes we use to verify a phone number, and receives the phone number for that purpose.
  • Amplitude. Amplitude provides product analytics in the mobile app so we can see how it is used and improve it. It receives events tied to your Beacon account identifier — for example signing in, or creating or joining a gathering — along with device and session information.
  • GlitchTip. GlitchTip records crashes and errors so we can fix them. It receives the technical details of the failure, your app version, your device and operating system, and your network address. Location data and credentials are removed before anything is sent.
  • Termly, Resend and the OpenStreetMap Foundation (our website only). Termly shows the cookie banner and records the choices you make in it. Resend sends email about our waitlist and our Vibe Curator programme and holds those sign-up lists, so it receives the name, email address, city and any other details you type into those forms. The OpenStreetMap Foundation serves the small preview map on our website, and receives your network address and the map area being previewed.
  • These companies are our service providers. They may use what they receive only to perform the service we have asked them for, on our instructions, and not for their own purposes. We do not sell your personal information and we do not share it with advertising networks or data brokers. If we add or change a service provider in a way that materially affects how your information is handled, we will update this list and, where required, tell you.

5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?

In Short: We may use cookies and other tracking technologies to collect and store your information.

We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.

We also permit third parties and service providers to use online tracking technologies on our Services for analytics (depending on your communication preferences).

To the extent these online tracking technologies are deemed to be a “sale”/“sharing” (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section “DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?” Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.

Analytics

We use product-analytics providers to understand how the Services are used and to improve them. In our mobile app we use Amplitude. On our website we use Google Analytics 4, deployed through Google Tag Manager. Google Analytics 4 is configured for analytics only, with Google Signals off, advertising and remarketing features off, and no cross-device or User-ID linking, and it loads only after you opt in through our cookie banner (Google Consent Mode keeps analytics denied by default until you consent). Once enabled, it collects standard analytics such as pseudonymous identifiers, page views, device and browser information, coarse location, and referral or campaign (UTM) parameters, together with a small number of first-party events, for example waitlist submissions (by city only), app-store button clicks, and share-link-to-store redirects. These providers act as our service providers and process information only on our behalf and on our instructions; they do not use it for their own purposes, for advertising, or for cross-context behavioral advertising.

We do not currently serve third-party advertising, use advertising or conversion pixels, sell or share personal information for cross-context behavioral advertising, or send marketing emails beyond a single launch announcement. If we begin any of these, we will update this Privacy Notice and provide the notices and choices required by law, including a Do Not Share opt-out and honoring the Global Privacy Control, before that processing begins.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?

In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.

Our Services offer you the ability to register and sign in using a third-party account. The only providers we support are Google and Apple. Where you choose to do this, we receive a limited set of profile information from that provider — your name, your email address (which, with Sign in with Apple, may be a private relay address that forwards to you), whether that email address has been verified, and an identifier for your account with the provider. We do not receive, request, or store your contacts, your friends or followers, your posts, or any other content from that provider. We will use the information we receive only for the purposes described in this Privacy Notice or otherwise made clear to you on the relevant Services.

7. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information, including facilities in the United States.

We do not currently offer the Services in the European Economic Area, the United Kingdom, or Switzerland. Before offering the Services in those regions, we will implement an appropriate cross-border transfer mechanism (such as the European Commission's Standard Contractual Clauses) and update this Privacy Notice accordingly.

8. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law. No purpose in this notice will require us keeping your personal information for longer than the period of time in which users have an account with us.

Notwithstanding the foregoing, the following retention periods apply. Biometric data used for the liveness check is not retained after the check completes; the check is performed in real time by our service provider, and no facial image or template is stored. The liveness check confirms that a real, live person is present. It does not compare your face to your profile photo, to any other person’s face, or to any database. Precise geolocation collected while you are using the Services is not stored beyond what is necessary to serve your live requests; where short-term storage is necessary, it is retained for no longer than 30 days. Separately, places you choose to save — such as your Home, Travel or Routine beacon — are stored at the location you set, and are kept for as long as your account exists so that they remain on your map. They are deleted when you delete your account. IP addresses, which can be coarsely geolocated, are retained for up to 12 months for security purposes. Location sharing between users is off by default and enabled only with your consent, and anyone viewing a shared link without an account sees only a coarsened general area, never precise coordinates.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible, we will securely store your personal information and isolate it from any further processing until deletion is possible.

9. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We aim to protect your personal information through a system of organizational and technical security measures.

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% secure. You should only access the Services within a secure environment.

10. DO WE COLLECT INFORMATION FROM MINORS?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. By using the Services, you represent that you are at least 18 years of age. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at privacy@beaconmeetup.com.

11. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on your state or region of residence, you have rights that allow you greater access to and control over your personal information.

In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws, which may include the right to request access to and obtain a copy of your personal information, to request rectification or erasure, to restrict the processing of your personal information, to data portability, and not to be subject to automated decision-making. To make such a request, use the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below.

Withdrawing your consent: If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time by contacting us.

12. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

We do, however, recognize and honor opt-out preference signals, including the Global Privacy Control (GPC), where required by applicable law. When we detect a GPC signal from a browser or device, we treat it as a valid request to opt out of the sale or sharing of personal information for that browser or device.

California law requires us to let you know how we respond to web browser DNT signals. Because there is currently no industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

13. DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?

In Short: If you are a resident of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia, you may have the right to request access to and receive details about the personal information we maintain about you and how we have processed it, correct inaccuracies, get a copy of, or delete your personal information.

How We Use and Share Personal Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We engage service providers, such as our product-analytics provider, that process personal information only on our behalf and on our instructions, which is not a sale or a share under applicable law.

Your Rights

You have rights under certain US state data protection laws, including the right to know, access, correct, delete, obtain a copy, non-discrimination, and to opt out of the processing of your personal data for targeted advertising, the sale of personal data, or profiling. Depending on the state where you live, you may also have the right to limit the use and disclosure of sensitive personal data and to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature.
